These Terms of Service (the "Terms") govern your access to and use of the Omni Flash website at omniflash.ai and the Omni Flash AI video generator, AI image generator, and related features (collectively, the "Service"). By creating an account or using any part of the Service you agree to these Terms. If you do not agree, please do not use Omni Flash.
You must be at least 13 years old, or the equivalent minimum age in your jurisdiction, to use Omni Flash. By using the Service you represent that you can form a binding contract and that you are not barred from receiving services under applicable law.
You are responsible for safeguarding the credentials of your Omni Flash account and for every activity that occurs under it. Notify support@omniflash.ai immediately if you believe your account has been compromised.
Omni Flash is a multimodal generative platform that turns text prompts, reference images, and chat instructions into cinematic videos and high-resolution images. Features evolve over time; the description in our marketing material and product pages reflects the current state of the Service.
Omni Flash offers monthly subscriptions, annual subscriptions, and one-time credit packs. Each plan includes a credit allowance that you can spend on generations. Subscription billing renews automatically at the end of each billing cycle unless you cancel before the renewal date. Credit packs are billed once and the credits never expire while your account remains in good standing.
You authorize Omni Flash and its payment partners to charge the payment method on file for all amounts owed.
We work hard to keep Omni Flash available, but we do not guarantee uninterrupted service. We may modify, suspend, or discontinue any part of the Service at any time. If we make a material change to a paid feature, we will provide reasonable advance notice.
Omni Flash may label certain features as "beta" or "experimental." Those features are provided as-is, may be unstable, and may be discontinued without notice. Beta features may not be covered by the same support response times as the general Service.
You retain the rights you already hold in the prompts you submit and the reference assets you upload to Omni Flash. You grant Omni Flash a worldwide, non-exclusive, royalty-free license to host, transmit, and process your content for the limited purpose of operating and improving the Service.
You agree not to use Omni Flash to:
We may remove content, throttle generations, or suspend or terminate accounts that violate these Terms or applicable law. Repeat or severe violations may result in permanent termination of your Omni Flash account.
Subject to your compliance with these Terms, Omni Flash assigns to you the rights, title, and interest we hold in the outputs you generate. You are responsible for ensuring that your use of those outputs complies with applicable law and any third-party rights.
Paid Omni Flash plans and credit packs include a commercial-use license for the outputs you generate while the plan is active. This license covers advertising, product imagery, social content, editorial use, and resale of finished creative works.
Omni Flash may embed provenance metadata in generated content to support transparency standards. We do not add visible watermarks to paid outputs.
You can cancel an Omni Flash subscription at any time. Cancellation takes effect at the end of the current billing period; you keep access until then. Refunds for partial periods are generally not provided, but we review requests on a case-by-case basis when you contact support@omniflash.ai.
Credit packs are non-refundable once any portion of the credits has been used. Unused credit packs may be refunded within fourteen days of purchase at our discretion.
You may request deletion of your Omni Flash account at any time. We will remove your personal data subject to the retention rules described in the Privacy Policy and any legal obligations we cannot waive.
Omni Flash is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that generated outputs will be accurate, fit for purpose, or suitable for any specific use.
To the maximum extent permitted by law, Omni Flash and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid Omni Flash in the twelve months before the claim arose, or (b) one hundred U.S. dollars.
You agree to defend, indemnify, and hold harmless Omni Flash and its affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Service, or your content infringing third-party rights.
Your use of Omni Flash is also governed by our Privacy Policy, which describes how we collect, use, and share information.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, when changes are material, provide additional notice through Omni Flash or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the jurisdiction in which Omni Flash operates, without regard to its conflict-of-laws rules. Any dispute will be resolved in the courts of that jurisdiction, unless mandatory law in your country of residence provides otherwise.
